All transactions are governed by Curaçao law and handled through the Courts of Curaçao.
1. General Information
The Sea Shack is a Curaçao-based supplier of premium diving and watersports equipment.
We provide products to both individual consumers and registered businesses.
We do our best to ensure all product information, pricing, and stock levels are accurate.
We reserve the right to update or correct any information at any time.
2. Orders & Payments
- Orders are confirmed once payment is received.
- Prices may change without notice.
- All taxes (including OB/Turnover Tax) are shown at checkout.
- Payment must be completed before shipping unless special B2B terms were agreed in writing.
3. Shipping & Delivery
- Delivery times are estimates and may vary due to carrier delays or external factors.
- Once handed to the carrier, responsibility for the shipment transfers to the buyer, in line with Curaçao transport rules.
- Shipping costs and any customs/import fees (if applicable) are the buyer’s responsibility.
4. Returns & Exchanges (Retail Customers)
Retail customers have 14 days to request a exchange from the date of delivery.
Items must be unused, in original condition, and in their original packaging.
Not eligible for return:
- Used items
- Hygienic gear (snorkels, masks, mouthpieces, wetsuits, rash guards) once opened
- Electronic equipment once unsealed
- Custom orders or special orders
- Clearance/final sale products
Exchanges are possible when stock is available.
Damaged or incorrect items must be reported within 48 hours of delivery.
5. Wholesale (B2B) Terms
Wholesale pricing is available only to verified businesses (dive centers, shops, rental facilities, watersports operators).
Wholesale terms:
- Minimum Order Quantities (MOQs) may apply
- Full prepayment is required unless written credit terms exist
- B2B orders are final sale
- Returns are only accepted for manufacturing defects or shipping errors
- Freight, customs, and import fees are the responsibility of the buyer
Wholesale partners must respect brand guidelines, MAP (Minimum Advertised Price) rules, and territory restrictions where applicable.
6. Warranty
Most products come with a manufacturer warranty.
Warranty claims must follow the manufacturer’s official process.
Proof of purchase is required.
Warranty does not cover:
- Damage from misuse or improper maintenance
- Normal wear and tear
- Unauthorized servicing or modifications
Regulators, BCDs, and tanks must be serviced by certified technicians.
7. Safety & Responsibility
Using diving and watersports equipment requires proper training and certification.
The Sea Shack is not responsible for injury or damage caused by improper use, lack of training, or failure to maintain equipment.
8. Liability
We are not liable for:
- Losses caused by misuse of equipment
- Damage from improper maintenance
- Delays caused by carriers or external factors
- Economic loss, lost revenue, or consequential damages
Items must be inspected and used according to manufacturer recommendations and Curaçao safety guidelines.
9. Intellectual Property
All images, product descriptions, designs, and branding on our website are owned by The Sea Shack or our suppliers.
They may not be copied, reproduced, or used without permission.
10. Privacy
We respect your privacy and handle your information according to Curaçao privacy regulations.
Customer data is used only to process orders and provide customer support.
